Montana Botanical Analysis (MBA) is the first analytical laboratory in Montana dedicated to the study and analysis of medical cannabis. MBA can provide valuable information about the types of medical cannabis available to qualified Montana residents. Patients & Families United is a statewide Montana support group for patients who use medical marijuana, regardless of their medical condition, and for patients who suffer from pain, whether they use medical marijuana or not. We do this through community involvement, active participation in the Medical Marijuana Growers Association, and our monthly newsletter. In November 2004, Montana voters by a significant margin (62 percent) passed Initiative 148, allowing certain patients with specific medical conditions to alleviate their symptoms through the limited use of marijuana under medical supervision.

The new law, effective immediately upon passage, also allows qualified patients and their caregivers to grow and/or possess a restricted number of marijuana plants.

Montana is the 10th state to pass a medical marijuana law. Under federal law, it is still illegal to grow, sell, purchase, or use marijuana, even for health-related reasons.

To use or grow marijuana under the Montana law, patients and caregivers must first register with the Quality Assurance Division of the Department of Public Health and Human Services.

Marijuana providers look to build respectable businesses
A few things stand out when you walk into the office of Zoo Mountain Natural Care Inc. in downtown Missoula. An ATM machine is all lit up next to the front desk. The reception area is behind a plexiglass window. Gaining access to the offices and care center requires a code that is punched into a lock.

On the wall in this tidy waiting area is the menu of patients' medicinal choices: Purple Urkle, Sensi Star, Bubba Kush, Goo, to name just a few. Some of the choices have such flamboyant names – names not suitable for a family newspaper – that they still elicit laughter from the staffers who see the list every day.

The distinctive names describe each strain of medicinal marijuana offered by the shop and reflect their former black market heritage, explains Tayln Lang, Zoo Mountain's general manager.

Before giving a tour and discussing the challenges of growing a respectable business whose main ingredient has a notorious past, Lang proudly points to the lower righthand corner of the plexiglass.

It prominently displays three signs: Missoula Area Chamber Commerce, Missoula Downtown Association and the National Federation of Independent Business.

"We are trying to promote a better business model within this larger business," Lang said. "We feel it is important that we all provide service in a conscientious way. We want to develop a code of ethics within the industry that addresses what is appropriate advertising content, and what is the message we want to convey.

Best Medical Marijuana Caregive
This new category captures a defining trend over the last year. The medical marijuana industry has exploded in Montana, and particularly in Missoula, home to more registered patients than any other county in the state. Of Missoula's roughly 500 caregivers, Indy readers vote Zoo Mountain Natural Care as the best.
Maybe it's because it sells about as many strains as the Rhino sells beers, or because ounces of medication only cost $225-$250. Whatever it is, Zoo Mountain-which became the first medical marijuana clinic to join the Missoula Chamber of Commerce-is riding high.

Review of Zoo Mountain Natural Care
Almost directly across the street from The Hemp and Cannabis Foundation, Zoo Mountain Natural Care (ZMNC) maintain an office in a funny looking building on the corner of Orange and Front street that dispenses cannabis 6 days a week, from 10 am until 6 pm. On February 21st at around 2:30, I stopped by to talk to a caregiver and pick up some of their best medical marijuana, and here are my results.

The most important factors that I look for in a good dispensary are price, product, storefront, and staff.

Price: (Correction) 4 1/2 Stars: After speaking with the owner Logan Head, I discovered that I was wrongly informed about the price changes; in fact, the prices started at $225 per ounce, then rose to $250 per ounce (and Mr. Head assures me prices will decline again once overhead costs are covered). Although ZMNC can't get a 5 due to their inability to process checks or credit cards, they do get 4 1/2 stars for a very affordable, quality pricing range.

House Speaker Looks To Repeal Medical Marijuana Law
HELENA, Mont. -- Republicans and Democrats aren't seeing eye to eye on the Medical marijuana law. Speaker of the House, Mike Milburn, wants the law to go up in smoke.

"It's pretty much opening the door to legalize marijuana is what this has done," Milburn told NBC Montana. "So, we have many issues on that on driving while using it, working and going to school."

Milburn is sponsoring a bill that would repeal the controversial law. He says it's allowing the drug to become too easily accessible. "Voters did vote for the initiative but it wasn't for what happened...and that's where I'm going to listen to what they're saying and what they're telling me is that the consequences of what's happening is way outweighing any benefits," said Milburn.

But representative Diane Sands begs to differ.

Medical marijuana groups work to preserve patients' right at 2011 Legislature
HELENA - Leaders of groups involved in medical marijuana issues said Wednesday they are integrating their efforts to preserve patients' rights in the face of opposition and backlash at the 2011 Montana Legislature.

They urged medical marijuana patients and caregivers around the state to join the effort in a constructive way.

"With two dozen bills being drafted relating to medical marijuana, and a lot of support among legislators to repeal Montana's medical marijuana law completely, we face an uphill climb to overcome the distortions and misperceptions that unethical behavior by a few has incited," said Tom Daubert of Helena, founder and director of Patients & Families United.

The fact remains that medical marijuana "is greatly improving the quality of life and productivity of thousands of Montanans who suffer diverse health problems," Daubert said.

House Speaker Mike Milburn, R-Cascade, is sponsoring a bill to repeal the state's medical marijuana law, which 62 percent of Montana voters passed as a ballot initiative in 2004. A number of other bills seek to control and regulate the industry in Montana.

Judge denies grassroots effort to stop pot in Deer Lodge
DEER LODGE - A district judge has denied a request from residents that would have forced the city of Deer Lodge to stop a commercial medical marijuana grow operation in town.

Judge Loren Tucker's ruling on Friday answers a lawsuit filed by 22 Deer Lodge people. They petitioned for a writ of mandamus requiring the city to enforce its ordinances prohibiting medical marijuana businesses from being located within 1,000 feet of a church.

In his ruling, Judge Tucker acknowledged wide and deep divisions in society's views about marijuana, but said the court has no authority to determine what policy should be adopted or to make the rules.

"The court is required to apply the rules enacted by the legislative and executive branches," he wrote. The lawsuit contended Zoo Mountain Natural Care Inc. violates city Ordinances 130 and 136, does not have a valid business license, did not obtain appropriate building permits and violates the rule prohibiting operation of a medical marijuana business within 1,000 feet of a church.

Committee Addresses Medical Marijuana Caregivers
Montana police and prosecutors' know there are no easy answers with Montana's current medical marijuana law. Helena lawmakers want to make it easier to prosecute for mis-using medical marijuana. For more than a year a special legislative committee's listened to how to fix the state's medical marijuana law.

This time it focused on caregivers. They are the people who sell and grow medical marijuana to patients. Committee members worry criminals can run dispensaries.

Mike Batista, with the Montana Department of Justice says "Marijuana is still an illegal substance in the state and we need to make sure we're doing the proper enforcement. One of the first steps of that is to ensure that people who do have criminal records are not engaged in the business."

And that's exactly what the committee did. It passed a recommendation saying anyone who has a felony on their record or has a drug charge conviction can't be a caregiver.

Green rush -- Getting a grip on Montana's budding medical marijuana industry
Not too long ago any talk of a "green" business had something to do with the environment or climate change. But a bumper crop of new medical marijuana businesses in Missoula—and across the state—forces a new definition of the phrase. Montanans are now coming to grips with a different kind of green business, and an emerging "green rush."

Much like the West's gold rush, the noticeable rise in cannabusinesses elicits a mix of heart-warming success stories, rampant opportunism and chaotic legal wrangling. More than anything, the current green rush speaks to just how fast the industry has grown since federal enforcement was relaxed late last year.

The numbers tell much of the story. At the end of 2008, Montana's Department of Public Health and Human Services (DPHHS) reported 1,557 registered medical marijuana patients in the state. One year later, there were 7,339. Based on current trends and estimates from those in the industry, the state likely added another 3,000-plus patients to the rolls in January.
